Texas Underage Drinking and Driving Attorney
A minor (any driver under age 21) is subject to Texas' Zero Tolerance law. Minors can be charged with driving under the influence (DUI) for any detectable amount of alcohol — one swig of beer is all it takes.
DUI is a class C misdemeanor punishable by fines, community service and 90-day license suspension, plus the criminal record. Subsequent offenses can result in jail time, higher fines and longer suspension of driving privileges.
Minors may be eligible for deferred adjudication to keep the DUI off their record if they stay out of trouble and comply with the court's terms. However, underage drivers can only get one deferment and a deferred adjudication still counts as a DUI conviction for purposes of future arrests.
Drivers who are over 18 but under 21 and found to have a blood-alcohol content (BAC) of .08 or greater are subject to the full adult penalties for driving while intoxicated (DWI).
